The court case on Safe Harbor
According to the ruling of the European Court of Justice (ECJ), companies in Germany and the European Union (EU) can no longer rely on the Safe Harbor Agreement when they transfer personal data to the U.S. or when they want to save, manage or process data in companies located there.
Safe Harbor does not protect from the authoritiess
In its decision, the Court especially criticized the fact that personal data in the U.S. are not, or at least are not sufficiently, protected against more-or-less arbitrary access by the American authorities. Even legal action against unlawful data processing is not possible.
